Debt Relief - Dealing With Debt

Dealing with your Priority Debt.

Now check back to your list of Priority Debts. You must deal with these first because:
- You may lose your home.
- You might get evicted.
- Your utilities may be disconnected e.g. electricity, gas or telephone.
- If you fail to pay a fine or a civil debt it may result in a prison sentence.
- Your car or goods on hire purchase could be repossessed.

Dealing with your Secondary Debt.

Now check back to your list of Secondary Debts. Remember they are:

Examples

- Bank Overdraft
- Catalogue Debts
- Credit Card Debts
- Credit Sales Agreements
- Credit Union Loans
- Personal Debts to friends and family
- Personal Loans with Finance companies

Although you can be taken to court if you fail to keep up with agreed payments, as long as you respond to court documents enclosing details of your financial circumstances, and you don't ignore the problem you will usually only have to pay what you can afford based on your budget.

Dealing with your Secondary Debt.

Housing and Utility Creditors:

They will normally be prepared to accept an amount on top of your normal bill amount so you can clear the arrears over time.

Other Creditors:

A fixed period of time is usually required here but isn't fixed in stone, so you will have to work out your weekly/monthly offers on this basis. If at all possible, try not to use all your surplus money on priority creditors, don't forget you will need some left over for your secondary creditors.
How to make an offer.

You need to send a letter detailing what you can afford to offer along with a copy of your financial statement to each priority creditor outlining the following:

- Make sure you include the account or reference number.
- As best you can explain why you are in financial difficulties. E.g. unemployment, sickness, relationship breakdown etc.
- Include the date at which you will be able to commence payments and for how much. N.B. Only offer what you can afford on top of your normal payment.
- Ask your creditor to suspend the interest and other charges.
- Use the pre written letter temp.

This statement will identify how much you have to offer your creditors. However, please take care and note that this is an important document and you need to take great care in completing it. What if Your offer is Accepted?

- Write back and thank your creditor for their cooperation in this matter.
- Inform them how you will be making payments. E.g. standing order, posting bankers draft, internet etc.
- Include your first payment with the letter.

What if Your offer is Not Accepted.

- Write back asking them to reconsider your proposal.
- Include with the letter the amount of your first proposal.
- Your creditor might refuse to freeze the interest and other charges. Just point out that your offer was based on the interest and charges being frozen, therefore the debt will not reduce.
- If your creditor still refuses to accept your offer then they can do nothing without going to court. (You might like to check with your local citizens advice as to the procedure process)
- Normally in most country's, if it's a higher purchase agreement and you have paid back one third of the loan, your creditor cannot repossess the goods automatically.

15 Negotiating Tips and Hints.

Here are 15 negotiating tips and hints to help you achieve a positive outcome:

1. Always be prepared, have your facts and figures to hand.
2. Make contact via, fax, letter, email or face to face rather than by phone. N.B. if it aint written down it didn't happen!
3. Know your bottom line. Stick to your budget and NEVER agree to pay more than you can afford.
4. Don't be intimidated and adjust your offers based on your creditors demands. Reinforce to them that your offer is based on your ability to pay.
5. DO NOT be aggressive and present yourself in a courteous and professional manner as much as possible.
6. Be honest and open about your situation
7. Be accommodating, polite and as flexible as possible.
8. DO NOT become frustrated and stay calm at all times.
9. Get everything agreed upon in writing
10. Reinforce and emphasize the mutual benefits of sustainable and affordable agreements.
11. Assure them that you will immediately contact them should your circumstances change.
12. Be sure to ask for the interest and other charges to be suspended to assist you in getting your finances back in order.
13. If you are getting nowhere in your negotiations then ask for contact with someone senior in the organization.
14. Make sure you record and advise reluctant creditors of others who have accepted your proposals. If necessary, look for a review of the proposal in the short term. E.g. 3-6 months.
15. Don't be afraid of court action. It can sometimes work in your favor.

Now it's Time For Positive Action

Your To Do List:

- Make a list of all your debts on a piece of paper.
- Check that you are liable for the debt. E.g. Is it in your name?
- Prioritize the debts that require your immediate attention e.g. Priority Debts and Secondary Debts.
- Contact your creditors immediately preferably in writing. Don't forget.... If it ain't written down, it didn't happen!!
- Prepare your budget sheet, either download it or prepare one yourself.
- Complete the Budget Sheet as accurately as possible.
- Keep a spending Diary for a week or two.
- Take your expenses away from your income to find out what you can afford to give each creditor.
- Write to each creditor detailing the amount you can afford to offer them, and only that amount. Don't forget to include a copy of your Financial Statement to your priority creditors.

Getting back on top of money issues does have its difficulties. This path is designed to help you manage these difficulties, overcome them and gain control of the situation. All of the recommendations in this plan are free for you to adopt. They will however, necessitate an investment of your time and will require you to take ACTION. These problems will not go away and will become harder for you to get under control the longer you let things drags on. Take action NOW and get your life back.
